1. Agreement to Terms
By accessing or using SmallShop, operated by BICRAW Consulting BV (Bampslaan 1/2, 3500 Hasselt, Belgium, Enterprise Number: 0658.917.436), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
SmallShop provides an e-commerce platform service that allows users to create and manage online shops. We design and build your online store, and you manage your products, orders, and customers through our dashboard.
3. Account Registration
To use SmallShop, you must:
- Be at least 18 years old or the legal age in your jurisdiction
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Pricing and Payment
Setup Fee: A one-time setup fee of EUR 200 is charged for the initial creation and design of your online shop.
Monthly Subscription: A recurring fee of EUR 20 per month is charged for continued access to the platform and services.
Transaction Fees: SmallShop charges 0% transaction fees. Standard payment processor fees (Stripe) apply separately.
Payment Terms:
- Setup fee is due before work begins on your shop
- Monthly fees are billed in advance
- All fees are exclusive of VAT where applicable
- Payments are processed securely through Stripe
5. Acceptable Use
You agree not to use SmallShop to:
- Sell illegal products or services
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Distribute malware or harmful content
- Engage in fraudulent activities
- Send spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
- Sell counterfeit goods
We reserve the right to suspend or terminate accounts that violate these terms.
6. Your Content
You retain ownership of all content you upload to SmallShop (products, images, descriptions, etc.). By uploading content, you grant us a license to use, store, and display this content as necessary to provide our services.
You are responsible for ensuring you have the rights to use any content you upload and that it does not violate any third-party rights.
7. AI-Generated Content
SmallShop offers AI-powered features for generating product descriptions and enhancing images. While we strive for quality, AI-generated content may require review and editing. You are responsible for reviewing and approving all content before it is published on your shop.
8. Payments and Your Customers
Payments from your customers are processed through Stripe and deposited directly to your connected Stripe account. You are responsible for fulfilling orders, handling customer service, returns, and refunds. SmallShop is not a party to transactions between you and your customers.
9. Cancellation and Refunds
Cancellation: You may cancel your subscription at any time. Your shop will remain active until the end of your current billing period.
Setup Fee: The setup fee is non-refundable once work has begun on your shop. If you cancel before any work has started, a full refund will be provided.
Monthly Fees: Monthly subscription fees are non-refundable for partial months.
10. Data Export
Upon cancellation or request, we will provide you with an export of your data (products, customer information, orders) in a standard format within 14 days.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will provide notice of planned maintenance when possible.
12. Limitation of Liability
To the maximum extent permitted by law, BICRAW Consulting BV shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from third-party actions
- Service interruptions or data loss
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless BICRAW Consulting BV from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.
14. Changes to Terms
We may modify these terms at any time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.
15. Governing Law
These terms are governed by the laws of Belgium. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Hasselt, Belgium.
